This SMS Policy describes the text messaging program operated by MCY Site Services, LLC d/b/a MCY Digital Marketing (“we,” “us,” or “our”) at mcydigital.com.
PROGRAM NAME AND DESCRIPTION
MCY Digital Marketing SMS Program
MCY Digital Marketing offers a transactional SMS program to prospects and clients who have opted in. We send text messages related to consultation requests, free report delivery, inquiry responses, and active client communications. We do not send marketing or promotional SMS messages.
PROGRAM TYPE
Transactional / Non-Marketing.
This means messages are sent in direct connection with an inquiry, consultation request, or active service engagement initiated by the customer or prospect. We do not send promotional offers, advertising, or general marketing content via SMS.
HOW TO OPT IN
You may opt in to receive SMS messages from MCY Digital Marketing through any of the following methods:
1. Contact Form: Check the SMS consent checkbox on our contact form at mcydigital.com/contact when submitting an inquiry. The checkbox is unchecked by default and is not required to submit the form.
2. Free Report Request: Check the SMS consent checkbox when requesting a free report at mcydigital.com. The checkbox is unchecked by default and is not required to submit the request.
3. Verbal Consent: Provide verbal consent during a phone call or scheduled consultation with our team at (832) 482-9422.
By opting in, you agree to receive transactional SMS messages from MCY Digital Marketing as described in this policy.
Consent is not a condition of service.
OPT-IN CONFIRMATION
After opting in, you will receive an SMS confirmation message acknowledging your enrollment in the MCY Digital Marketing SMS program. The confirmation message will include our brand name, opt-out instructions, help instructions, and message frequency disclosure.
TYPES OF MESSAGES YOU MAY RECEIVE
- Consultation scheduling confirmations and reminders
- Free report delivery notifications
- Responses to inquiries submitted through our Site
- Account and service updates for active clients
- Project milestone and deliverable notifications
- AI receptionist responses to inbound text messages
MESSAGE FREQUENCY
Message frequency varies based on your engagement activity. You will typically receive 1 to 4 messages per active inquiry or project milestone.
MESSAGE AND DATA RATES
Message and data rates may apply per your mobile carrier’s plan. MCY Digital Marketing does not charge you for sending SMS messages, but your wireless carrier may charge for receiving them. Contact your carrier for details on your messaging plan.
HOW TO OPT OUT (STOP)
You may opt out of SMS messages from MCY Digital Marketing at any time using any of the following methods:
1. Reply STOP to any message you receive from us. You may also reply with: UNSUBSCRIBE, CANCEL, END, or QUIT.
2. Call us at (832) 482-9422 and request removal from SMS notifications.
3. Email hello@mcydigital.com with an opt-out request.
After opting out, you will receive a final confirmation message acknowledging your opt-out request, and you will no longer receive SMS communications from us. Opt-out requests are processed promptly.
HOW TO REJOIN SMS
If you previously opted out and wish to receive SMS messages from MCY Digital Marketing again, you may re-opt in through any of the methods described in the “How to Opt In” section above. After re-opting in, you will resume receiving SMS communications.

NO MOBILE INFORMATION SHARING
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service and technical service delivery, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
This no-sharing policy applies specifically to:
- Mobile phone numbers collected during opt-in
- SMS consent records and timestamps
- Mobile device identifiers
Mobile opt-in data is used solely to provide service-related SMS communications to the customer or prospect who provided consent.
CARRIER LIABILITY DISCLAIMER
MCY Digital Marketing and participating mobile carriers are not liable for delayed or undelivered SMS messages. Message delivery is subject to your carrier’s network and is outside our control. We are not responsible for:
- Messages delayed or not delivered due to carrier issues
- Messages filtered as spam by your carrier
- Messages not received due to device, network, or service interruptions
- Charges incurred from receiving our messages
COMPLIANCE WITH INDUSTRY STANDARDS
MCY Digital Marketing’s SMS program is operated in compliance with applicable industry standards, including the CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (TCPA), and applicable state and federal regulations governing commercial text messaging.
AGE RESTRICTION
Our SMS program is intended for users aged 18 or older. By opting in, you represent that you are at least 18 years of age.
CHANGES TO THIS POLICY
We may update this SMS Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Continued use of our SMS program after changes constitutes acceptance of the updated policy.
